Document Production in Legal Discovery
During litigation discovery, parties must produce documents in organized, numbered formats. PDF tools automate what was once manual work, reducing costs and errors.
Bates Numbering Requirements
Bates numbers provide unique identifiers for every page produced:
- •Format typically: PREFIX-000001 (e.g., SMITH-000001)
- •Numbers must be sequential across all documents
- •Position: Usually bottom-right corner
- •Must not obscure document content
- •Should be consistent size and font
Redaction for Privileged Information
Documents often contain information that must be withheld:
| Redaction Type | Examples | Requirement |
|---|---|---|
| Attorney-client privilege | Legal advice emails | Complete removal |
| Work product | Case strategy notes | Complete removal |
| Personal identifiers | SSN, account numbers | Obscure numbers |
| Trade secrets | Proprietary formulas | Complete removal |
Why Proper Redaction Matters
Simple black boxes over text can be removed in some PDF viewers. True redaction must permanently delete the underlying text data. Courts have sanctioned attorneys for producing documents with removable redactions that exposed privileged information.
Document Organization
Produced documents need logical organization:
- •Group related documents (e.g., email chains together)
- •Maintain original folder structure when relevant
- •Create cover sheets or indices
- •Split very large PDFs for manageable review
Confidentiality Stamps
Many productions require confidentiality designations (e.g., "CONFIDENTIAL - ATTORNEYS' EYES ONLY") stamped on each page. This is similar to watermarking but with specific legal language.
